Lawyer Question About Car Repair?

I had work done by NTB (National Tire %26amp; Battery). They replaced the two front break pads and rotors and shaved the rear wheel drums in the back tires. Not even an hour later my caliper fell off the car when I was driving and lost all break fluid and could not break at all. Luckily I was on a side road and pulled off to the side. If I was on a major highway I could of killed someone. They sent a tow truck and fixed everything free of charge and issued a full refund for services. I was wondering if I could take legal action? I am in Baltimore, MD. This is a national buisness and I am very upset that the tech obvioisly doesn't know what he was doing. They didn't even fire him... What would you take legal action for? They already "made you whole" so to speak by repairing everything and giving you a refund. To sue successfully you need to show damages, and you don't have any.



That said, it does sound like they messed up pretty badly. I would recommend sending a complaint letter to the owner/manager of the store where the repairs were done as well as corporate headquarters. You could also explain what happened on business review sites such as yelp. Ask them what torque setting they did they did the caliper bolts too and how they suspensed the caliper whilst swapping out the pads. They may of bled the system and left a bleed nipple loose also. If that happens again then use the lower gears and handbrake to slow the car. since you were not at a monetary loss and there was not property damage, what would you sue for?



anyone can sue for almost any thing but you would need to find a lawyer that would make something up like you lost time from work or suffered a financial loss due to their negligence
They repaired the mistake and issued you a full refund.
